Lost Opportunity in CSA Reform
The UK Government’s refusal to include provision for the recognition of Scottish Minutes of Agreement in the legislation to replace the discredited Child Support Agency is a “lost opportunity” according to Angus MP Mike Weir.
Mr Weir had moved a motion at the Committee stage of the Bill seeking to amend the legislation to allow separating couples to enter into binding and enduring Minutes of Agreement dealing with child support and other matters. At present such agreements would be limited to a twelve month period. The motion was opposed by the government, although it received support from other parties.
Commenting on the issue Mr Weir said:
“The government say they want couples to enter into agreements between themselves, but the existence of the twelve month rule is a serious stumbling block to the use of voluntary agreements. If they can be overturned by either party after only twelve months, what is the point of entering into such an agreement.”
“Under the Scottish system a Minute of Agreement can be recorded and enforced in the same way as a court decree. Normally such agreements would include provisions for changes should there be a material change in circumstances. They are a useful way of dealing with matters on separation and offer a good route to enforcement in the event of a dispute.”
“The continual refusal of Ministers to remove the twelve month rule is a serious lost opportunity to allow separating couples to reach amicable agreements and perhaps establish a clean break. It will also mean that many more people than necessary will use the agency rather than enter into agreements.”
